‘Ignition‘ hitmaker R. Kelly may have ignited a legal campaign to be freed from his current 30-year prison sentence for racketeering and sex trafficking, but a New York appeals court was none-too-impressed as evidenced by their denial of his appeal on Wednesday (February 12).
“We have considered all the arguments presented by Kelly on appeal and concluded they are without merit,” the decision read according to online court records.
The news served as a crushing blow for the embattled R&B star, but his lawyer – Jennifer Bonjean – suggests the fight for his freedom is far from over.
Over three years after Kelly was found guilty for reportedly running a criminal enterprise that aided him in sexually abusing underage girls, Bonjean and her legal mounted a campaign to have the singer-songwriter granted a retrial or his conviction overturned all together.
Having failed at her most recent swing at bat via Wednesday’s ruling, Jennifer admitted to the press she was “disappointed” by the decision but is considering taking Kelly’s case to the highest Court in the land.
“We believe the United States Supreme Court will be interested in reviewing this unprecedented opinion that gives the government limitless discretion to apply the RICO statute to situations absurdly remote from statute’s intent,” she said in a statement to ‘USA Today’. “The statute was intended to punish organized crime — not individual conduct. This decision paves the way for prosecutorial abuse of the RICO statute.”
At writing, she has not confirmed a timeline for her escalation plan.
Her statement came not long after a U.S. Second Circuit Court of Appeals in New York maintained there was “sufficient evidence to support each of Kelly’s convictions, including for the state and federal violations underlying his Mann Act convictions.”
“Enabled by a constellation of managers, assistants, and other staff for over 25 years, Kelly exploited his fame to lure girls and young women into his grasp,” the decision read about Kelly. “Evidence at trial showed that he would isolate them from friends and family, control nearly every aspect of their lives, and abuse them verbally, physically, and sexually.”
