Citing analysis from an expert musicologist, Judge Monica Ramirez Almadani rules that there weren’t any similarities in the two very different songs besides them being commonplace Christmas song clichés.
She states:
“Plaintiffs have not met their burden of showing that [the songs by] Carey and Vance are substantially similar under the extrinsic test.”
Almadani also notes the lawsuit is frivolous and that Vince Vance‘s team has to pay for Carey’s legal fees. Citing that the songwriter’s conduct causes unnecessary delay and needlessly increases the costs of litigation.
The drama all started in 2022 when Vance alleged that the ‘Touch My Body’ singer stole the song title of his 1989 Christmas hit ‘All I Want for Christmas Is You’.
