Texas Man Charged With Capital Murder In Shooting Of 5-Year-Old Black Girl

A 47-year-old white man is being held without bond on a capital murder charge — the most serious offense under Texas law, and reserved for killings with specific aggravating factors, including the murder of a child under 10, and punishable by life without parole or the death penalty — after admitting he fired five rounds into a car carrying a Black mother and her five children over the weekend, killing a 5-year-old in what investigators describe as a case of mistaken identity.

Jeremy Porter was arrested Sunday, a day after the shooting on Grant Road near Jones Road in northwest Harris County, Texas, according to Click2Houston. Witnesses said the shooting happened as the vehicle traveled westbound, and two people inside were injured by broken glass. Zah’Layah Walton, 5, was struck by gunfire and later pronounced dead at a hospital.

Her mother, Monica Hicks, said she was driving her five children home from her own mother’s house Saturday night when the shots rang out. Hicks has said she never exchanged words with Porter, and never saw his truck before the shooting began.

Flock Safety cameras helped investigators track down Porter’s Ford truck, which they located “at a home,” as reported by Click2Houston. Harris County Sheriff Ed Gonzalez said the automated license-plate-reader technology played an important role in helping detectives quickly develop information, announcing Porter’s arrest Sunday night. Gonzalez contrasted the speedy arrest with the 2018 killing of 7-year-old Jazmine Barnes, also Black, in a similar roadway shooting that took investigators more than a week to solve without today’s camera network.

KHOU reports that Harris County District Attorney Sean Teare addressed the case after Tuesday’s hearing, saying, “This isn’t the first little girl who’s been shot and killed in her parent’s car in Harris County. It’s unacceptable.”

Officers say Porter admitted he was the driver and fired five rounds at the vehicle, telling them he believed it had fired at him and was driving erratically, according to Yahoo News; investigators found four “bullet defects” in the family’s car.

But that account has drawn scrutiny. The Houston Chronicle reports that evidence suggests Porter may have shot his own truck to bolster his self-defense claim, noting investigators found a bullet hole in the driver’s-side door of his vehicle but no matching damage on the passenger side, where he says the threat came from.

A judge ordered Porter held without bond for at least 10 days, until his next hearing, as prosecutors have filed to deny him bail entirely. Porter did not appear at his initial probable cause hearing after authorities said he was being disruptive.

Porter remains jailed and faces a long bid as the investigation continues.
