Trump’s Latest Election Tantrum Is A Lawsuit To Toss California Mail-In Ballots

When the emperor is a petulant child, that usually means a bunch of nuisance lawsuits because he has the ovaries to say this will be a huge waste of time.
Nevertheless, President Trump’s administration filed a lawsuit Sunday looking to force California officials to throw out thousands of mail-in ballots that the administration claims were sent to noncitizens ahead of the midterm elections.
“During a rare weekend oral argument, two judges on a three-judge panel of the 9th U.S. Circuit Court of Appeals sharply questioned a Justice Department lawyer about the lawsuit, a high-profile effort by the Trump administration to boost the federal government’s role in elections ahead of the Nov. 3 midterms,” Reuters reports.
Trump’s henchmen, also known as the Department of Justice, are showing that Trump will stop at nothing to ensure the midterm results are just as he likes them. He’s petrified that Democrats will seize control of Congress and end his reign as the worst president with the tiniest hands.
After a two-hour oral argument, Circuit Judge Mark Bennett said the three-judge panel would try to rule as quickly as possible.
Trump has continuously threatened that the Justice Department will be deployed to California if they refuse to identify suspected noncitizens on voter rolls. Apparently, 20,000 people have been targeted as likely illegal residents who may vote in the state, which so happens to be a Democratic stronghold.
California noted that it has its own safeguards to prevent noncitizens from voting and added that, of course, the Justice Department is looking to stop state voting because they are using suspect data.
“All available evidence indicates that ineligible voting, including noncitizen voting, is exceedingly rare. A Reuters investigation this year found just 129 cases in which noncitizens were federally charged with voting illegally; many appeared to stem from voter confusion or administrative errors, rather than intentional fraud,” Reuters reports.
But that didn’t stop the Justice Department from filing its lawsuit in federal court in Los Angeles on Oct. 15. The lawsuit sought permission to separate ballots it received from people on the administration’s list from the rest and not count them until it could verify the voters were citizens.
The plaintiffs filed an emergency motion with the 9th Circuit.
Judge Bennett, a Trump-appointed judge, said Sunday that the lawsuit could be reconciled with a provision of the Constitution known as the Elections Clause, which allows states to set the election processes.
“It seems to me that you want us to issue an injunction that is entirely inconsistent with the law that the California Legislature has adopted pursuant to the Elections Clause,” Bennett told Justice Department attorney Matthew Donnelly. “How can we do that?”
What Bennett was asking was rhetorical since he knows that they cannot do this, which is what makes all of this exhausting, but this is what happens when you don’t tell a child “no.”
