Supreme Court Upholds Block On Trump’s Mail-In Voting Executive Order [Op-Ed]

We can all breathe a sigh of relief as the Supreme Court has upheld a block against President Donald Trump’s executive order that would’ve significantly restricted mail-in voting.

AP reports that the Supreme Court issued an emergency ruling on Monday night. In a 7-2 decision, the Court found that the administration’s efforts will likely fail in court, though it didn’t give an exact reason. While Justice Brett “I like beer” Kavanaugh ruled against implementing the rule ahead of the midterms, he indicated he could rule in favor of the Trump administration if the issue is brought back to the court. 

Justice Samuel Alito and Clarence Thomas, aka the usual suspects, were the only two justices to dissent in the order. Alito said that he believed the Postal Service “has broad authority to regulate the mail.” I’m no Supreme Court justice, but I feel like regulating the mail and regulating election laws are two very different things. 

The Supreme Court’s ruling, for now, ends a long and winding legal battle against Trump’s executive order. Under the order, the United States Postal Service was required to create a rule that forced postal workers to withhold mail-in ballots in states that haven’t submitted their voter rolls to an online portal. The order also required states to redesign the envelopes used to deliver mail-in ballots. 

Election officials in several states have argued that the new rule was being implemented too close to the midterm elections, and multiple courts agreed and blocked the executive order. 

“Today is a good day for democracy, the rule of law, and the American people looking to exercise their constitutional right to vote,” California Gov. Gavin Newsom said in a statement regarding the ruling. “Finally, fifty days out, and the American people have certainty when it comes to our country’s electoral process: Voting is safe, vote-by-mail is accessible to any and all who need it.”

While the Trump administration is facing a significant setback in its attempt to disenfranchise a third of registered voters, that hasn’t stopped it from continuing to attack election laws and raising uncertainty about the outcome of the midterms. The Department of Justice sent letters last week to election officials in 30 states demanding they maintain their 2024 election records, telling them they are under investigation and facing potential litigation. 

It’s wild that so many people are willing to exert time, effort, and energy into propping up an obvious lie concocted by a doddering old man who can barely stay awake during meetings in the Oval Office. 

Despite Trump’s approval ratings continuing to plummet, the nation being in a protracted war that nobody wanted, said war exacerbating the ongoing cost of living crisis, food being more expensive and of questionable quality, and the Trump administration using its legislative power to make life harder for a wide swath of Americans, the administration is still arguing that the only way they can lose the midterms is through fraud. 

Could you imagine if the Trump administration put the same amount of energy into legislation that actually helped the American people as they do propping up a lie about voter fraud? It’d almost be like they’re doing the job they were elected to do. What a crazy concept.
