Secret Federal Court Deports Afghan Woman Dubbed ‘Alien Terrorist’ [Op-Ed]

My mama always repeated the refrain, “What doesn’t come out in the wash will come out in the rinse,” meaning … give it enough time, and all will be revealed.
And speaking of WASHED, the Trump regime has found yet another way to enact its draconian (and oft illegal) policies on “immigration reform,” through the use of a secret federal court.
The Justice Department announced on Friday that an Afghan national but a legal permanent U.S. resident was tried and convicted in the Alien Terrorist Removal Court and was deported on Friday, Axios eports.
The court deported 47-year-old Nazira Haji Zada — an Afghan woman living in Texas, who allegedly assisted her son and son-in-law in a 2024 foiled terror plot on Election Day. The BBC reports that Haji Zada was labeled the group’s “matriarch” and helped “radicalize” her family.
Haji Zada conceded that she was an alien terrorist, according to the Justice Department, but she may not have had a fair trial (surprise, surprise)
The Washington Post reports that Haji Zada’s court-appointed lawyers said they were denied access to the evidence in her case.
“Our client’s choice to consent to removal should not be seen as an endorsement of this court’s legitimacy,” public defenders Matthew Farley and Mary Manning Petras said in a statement to The Post.
“Dragging lawful permanent residents into court but refusing to show them or their attorneys the evidence that will be used against them is a plain violation of due process. We are confident that the Alien Terrorist Removal Court will be struck down as unconstitutional as soon as a judge is asked to address the issue,” they said.
The administration/regime revived the Alien Terrorist Removal Court this summer, though it was established in 1996 by Congress to quickly deport accused terrorists and not risk national security through public proceedings. Until now, the court had never heard a case.
Of course, the administration did a victory lap on Friday; it has been very cunning in finding new and/or dubious ways to use the law to bend U.S. policies to its will.
“This landmark case, resulting in the prompt removal of this alien terrorist to her country of origin, is a win for national security and the rule of law,” Attorney General Todd Blanche said in the press release. “Those who support and condone terrorism should not be living in the United States, and this first-ever case before the ATRC shows how the Department will use every tool at its disposal to protect our country.”
Keeping evidence from both the public AND the person being accused is antithetical to everything the American judicial court is supposed to stand for.
And, as many have said, this administration is testing these unconstitutional policies on the least of us, before they turn them on American citizens. Or, put another way by Angela Y. Davis: “If they come for me in the morning, they will come for you in the night.”
