NAACP Files Lawsuit To Block Federal Agents From Polling Sites 

The NAACP, along with a coalition of civil rights groups, has filed a lawsuit against the Trump administration over threats to send armed federal agents to polling sites during the midterms. 

The New York Times reports that the lawsuit accuses the Trump administration of violating Section 11(b) of the Voting Rights Act, which bars intimidation, coercion, or threats intended to prevent people from voting or helping voters. While the Supreme Court gutted part of the Voting Rights Act earlier this year, this section remained untouched. 

I feel like I need to add a “for now” at the end of that, because I’m sure the Supreme Court’s conservative supermajority would find some way to justify voter intimidation.

The act, the lawsuit says, broadly protects against voter intimidation, and requires only that voters reasonably fear being subject to harassment or violence for casting a ballot. “The breadth of Congress’s words was by design,” the lawsuit says.

This is at least the second lawsuit seeking to block the Trump administration from deploying armed federal agents near polling stations. Last week, the City of Denver, Latino civil rights organizations and government watchdog groups argued in a lawsuit that allowing immigration agents at voting locations violates a separate federal law protecting free and fair elections.

For months, Democrats have voiced concerns that Mr. Trump is seeking to assert greater control over the coming elections and sow doubt about the outcome. While Trump administration officials have said there is currently no plan to deploy armed agents to polling sites, they have also not ruled out the possibility of doing so.

The NAACP argued in its lawsuit that these actions have resulted in “voters, especially voters of color, [being] intimidated and fearful of engaging in the democratic process.” The lawsuit seeks to prevent the federal government from sending out federal agents to polling sites during the midterms. The lawsuit was driven by the Department of Justice announcing last month that it will send 1,000 election monitors to polling sites during the midterms.

Despite handily winning the 2024 election, President Donald Trump has spent much of his second term trying to sow mistrust in the electoral process. As a result of Trump’s loss in the 2020 election, he has continually been perpetuating the lie that there’s widespread voter fraud. 

That lie has been the basis of all Trump’s attacks on the electoral process. The Trump administration has repeatedly tried to coerce states into sending their voter rolls, even sending FBI agents to seize voting records from the 2020 election in Georgia’s Fulton County. A whistleblower recently revealed that the Department of Homeland Security may be breaking the law as part of its investigation into states’ voter rolls, and how can we forget Trump’s failed executive order to try and restrict mail-in voting? 

Oh, and FBI Director Kash Patel refused to confirm or deny plans to send FBI agents to polling sites during a hearing before the Senate Judiciary Committee earlier this week. 

But hey! This is about election integrity, OK? These aren’t blatant attempts to federalize elections, intimidate non-white voters, and sow distrust in our elections, even if that’s exactly what it all looks like.
